What is an Civil Partner Visa?

The term ‘Civil Partner visa’ is typically used in reference to the visa category for civil partners of someone based in the UK, who would like to join their partner in the UK.

Alternatively, you might be looking to apply for a ‘Proposed Civil Partner visa’, if you would like to move to the UK to enable youto enter into a civil partnership with your UK-based partner.

These visas come under the Home Office’s broad banner of family visas, and the Civil Partner visa UK requirements are largely the same as those that apply for other UK family visas.

If you are approved for the Proposed Civil Partnership visa for the UK as a proposed civil partner, you will be expected to enter into a civil partnership with your UK-based partner within six months of your arrival in the UK.

What are the requirements for an Civil Partner Visa?

If you are a civil partner or proposed civil partner looking to obtain the Civil Partner visa for the UK, you will only be able to apply if both you and your partner are 18 years of age or older.

Your partner is also required to either:

  • Be a British or Irish citizen
  • Have settled in the UK – for instance, they have indefinite leave to remain, settled status or proof of permanent residence
  • Be from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status –they must have begun living in the UK prior to 1 January 2021
  • Have a Turkish Businessperson visa or Turkish Worker visa
  • Have refugee status or humanitarian protection in the UK

It is also expected that you and your partner will intend to live together in the UK permanently after applying for the UK Civil Partner visa.

The Civil Partner visa UK requirements also include proving at least one of the below:

  • You are in a civil partnership or marriage that is recognised in the UK
  • You have spent a minimum of two years living together in a relationship at the time of your application
  • You are a proposed civil partner and will enter into a civil partnership in the UK within six months of your arrival

In the event of your civil ceremony being delayed due to COVID-19 (coronavirus), you may have the option of asking for an extension of your stay in the UK. As this can be a fast-moving and unpredictable situation, if this is the case for you, please contact our immigration lawyers for the latest advice and guidance.

Applicants for the Civil Partnership visa or Proposed Civil Partner visa will also need to prove they have a good knowledge of the English language, as well as that they will be able to financially support themselves on this visa. As a proposed civil partner, you will also be required to prove that any previous marriages or civil partnerships have come to an end.

Proving to the Home Office that your relationship is genuine is another key part of the process of securing a Civil Partner visa for the UK.

To satisfy this requirement, you will be expected to send evidence that:

  • Comes from the government, a bank, landlord, utility provider, or a medical professional
  • Confirms your relationship with your partner – for instance, that you live together, share expenses or are already in a civil partnership
  • Is less than four years old

Examples of such evidence accepted by the Home Office include:

  • A civil partnership certificate
  • A tenancy agreement, utility bills or council bills confirming that you pay bills together or live at the same address
  • A bank statement from a joint bank account, or confirming that you live at the same address
  • A letter from your doctor or dentist confirming that you live at the same address

Some candidates for the Civil Partnership visa may struggle to gather evidence that meets the above criteria. If this is the case for you, there is alternative evidence that you may be able to provide. However, such evidence is less likely to convince the Home Office to grant you a visa.

Examples of such possible alternative evidence include:

  • A one-off bill such as home repair costs or vet’s fees
  • Letters confirming that you and your partner are on the voting register for the same address
  • Student finance paperwork confirming that you live at the same address

You probably will not be successful in being approved for a UK Civil Partner visa if your submitted evidence for your relationship being genuine only consists of such things as travel tickets, receipts, greetings cards, photographs, or text or social media messages.
