Our client, a Korean national, completed his Master’s in Business and Economics and spent one year on a post-study work (PSW) visa, during which he established a business.
The business achieved a turnover of £200,000 in its first year. However, to remain in the UK on a permanent basis, operate his business effectively, and pursue settlement, our client needed a more stable and long-term immigration status.
We began with a free consultation to understand his immigration history and gather relevant information about his business. Based on this, we advised him to take the self-sponsorship route by obtaining a sponsor licence and sponsoring himself for a job role applicable to his position in the company.
We informed him that the appropriate personnel for the licence, specifically the authorising officer, had to be based in the UK and settled here. As he couldn’t provide this, we assisted by referring him to a third-party director services company. Additionally, we provided him with an HR pack to meet all his HR requirements for the Home Office.
Our assistance included a thorough document review, conducted in two stages: initially, we evaluated the documents he provided, identified gaps, and offered detailed feedback for necessary revisions.
In the final stage, we reassessed the revised documents to ensure compliance with UK Visas and Immigration (UKVI) requirements. We also prepared robust legal representations, outlining how he met the relevant Immigration Rules and demonstrating how his documents supported his eligibility for the sponsor licence.
Our comprehensive support enabled the client to successfully navigate the complexities of the self-sponsorship route. He obtained the sponsor licence and sponsored himself into a suitable job role within his company.
This allowed him to stay in the UK on a more permanent basis, ensuring the effective operation of his business and paving the way for his settlement in the UK.
