Our client’s journey towards a new life in the UK reached a critical juncture in 2024, as they faced their initial tribunal hearing in Bradford, West Yorkshire. Unprepared and without proper legal representation, they received a refusal decision from the immigration judge, sparking a period of reflection and determination to contest the Home Office’s decision.
Between 2022 and 2024, our legal team diligently lodged appeals against the refusal decision on behalf of our client. We advised them that the initial refusal by the immigration judge, in our opinion contained errors of law which, we argued, required further consideration by the Upper Tribunal.
In collaboration with a barrister, grounds were prepared explaining why the immigration judge had made errors in law which ultimately resulted in them making a negative decision against our client.
The application for permission to appeal against the decision was made to the First-tier Tribunal, which was successful as they agreed that there was a possible error. Following the granting of permission, a hearing was listed at the Upper Tribunal to further these arguments.
We arranged for a barrister to attend the hearing, during which an Upper Tribunal judge listened carefully to both our barrister and the Home Office representative.
Despite the challenging weather outside, within the courtroom, our client felt supported and calm. Guided by our barrister’s articulate arguments and backed by compelling evidence, including a witness statement from a charity director, our case was strong.
The judge’s patient demeanour set a positive tone for the proceedings, culminating in a sense of pride and joy as we left the courtroom. Through our collective efforts and unwavering commitment to their case, our client’s safety and freedom were secured
