Our client, an Indian national, approached us with regard to applying for indefinite leave to remain for him and his family. He had previously entered the UK on a Tier 2 ICT visa, which does not lead to settlement rights in the UK. He had successfully transitioned into a Tier 2 (General) visa and had reached the end of the five-year term under the Tier 2 (General) visa. During his residency, he and his wife were blessed with the birth of two children.
He now sought to apply for indefinite leave to remain in the UK.
We advised our client about the relevant documents necessary to apply for indefinite leave to remain, including the salary requirements, the relevant period relied upon, and knowledge of the English language and life in the UK.
We had to pay special attention to his absences as he had a long absence in a 12-month period when he was outside the UK for work. We calculated his days of absence and reassured the client that his absence would not break his continuous residence. We also had to pay attention to his last 12 months’ salary, as his salary included basic salary and commissions which varied each month.
We also requested a letter from his employer explaining the salary and commissions. After reviewing the documents, we submitted the online application. He wanted to apply for a super-premium service as his mother was unwell and he wanted to travel to India to see her.
Due to the COVID-19 pandemic, the availability of a biometric enrolment appointment was an issue. However, our team was able to check the appointments on a regular basis and managed to find an appointment within a week.
Our client visited the visa application centre and provided all the documents. He received the decision on the same day and was granted indefinite leave to remain. He was very happy as he was then able to book a flight to India to see his mother. He thanked us for all the support and excellent service he received from our team.
