An elderly Libyan national was successful in her application for a spouse visa.
An elderly UK citizen sought our help to bring their spouse to the UK on a spouse visa. The couple had been married for over 40 years but had been living separately due to their work commitments. The UK citizen was a businessman who was based in the UK but travelled regularly for work. They had decided long ago at that time that it would be best for her to remain in Libya with their children. He would of course visit them frequently.
Cranbrook Legal carefully assessed their unique situation and guided the couple on the complexity of the matter. We advised that the relationship requirement would be tough to meet, but that full and proper explanations backed up with appropriate evidence would increase the chances of the Home Office accepting the relationship as genuine.
Furthermore, as the UK citizen had retired recently, he did not have employment or self-employment to satisfy the financial requirement. We advised the couple that they could rely upon his savings, provided that he had the required amount for the required amount of time. We provided them with a bespoke documents list outlining all the documents that would be needed for the application.
Given the couple’s ages, the team at Cranbrook Legal went above and beyond by liaising with third parties to help obtain the documents on behalf of the couple. This was a difficult exercise because it involved contacting organisations in different jurisdictions.
With persistence, however, the relevant documents were obtained, and we were then able to prepare and submit the application. It was crucial that the legal representations sufficiently outlined their personal circumstances, detailing their separation and the reasons for it.
After submission of the application, we uploaded the documents that the client would be relying upon, and arranged for her appointment at a local visa application centre in Libya.
The spouse visa application was successful, allowing the couple to reunite and spend their golden years together in the UK.
